  • CAR ACCIDENT INJURIES
    CAR ACCIDENT INJURIES

A car accident can happen at a blink of an eye and within just few moments the lives of those involved may be negatively impacted for the years to come. According to the latest Ontario Road Safety Annual Report over 34,000 fatal and personal injury collisions took place in Ontario in 2014 injuring over 47,000 and killing over 450 persons. Unfortunately, these numbers continue to grow. Neck and back injuries, broken bones, and torn ligaments are very common injuries for victims of motor vehicle collisions. In more severe cases, victims of accidents are left with brain injuries, amputations or spinal cord injuries.

If you or someone you love has been injured in a car accident, it is important that you learn your rights as you may be entitled to compensation for your pain and suffering, your past and future loss of income and future medical treatment.

Even if you are at fault for a collision, you may be entitled to claim Accident Benefits from your own insurer or from another insurance company. It is very important that you act quickly to protect your rights. The claims process is rather complex and there are several deadlines that need to be met when seeking compensation.

At Lofranco Corriero, we have represented thousands of accident victims who have been injured in motor vehicle collisions. We have the knowledge and experience necessary to help you and support you on your path to recovery. If you have any questions regarding your rights and/or would like to schedule a free, no-obligation consultation, call us now at 1-866-LOFRANCO.

If as a result of your injuries you are unable to travel to one of our conveniently located offices, our representatives can come to meet you at the place and time of your convenience. During the first free and no-obligation consultation, we will work with you to better understand the facts of the accident and circumstances surrounding the collision, the nature of your injuries, as well as the impact the accident is having on both your personal and professional life.

If you have been injured in a car accident, you may have two options for financial recovery:

    TORT CLAIM

A Tort Claim is a claim for damages (or money) that you may be entitled to provided that you are not at fault for a collision and you pursue a claim against a negligent or at fault driver for your pain and suffering, lost wages, past and future lost income, future health care expenses and out-of-pocket expenses like home maintenance and other related services.

    ACCIDENT BENEFITS CLAIM

Accident Benefits are available to you regardless of fault. They include up to $65,000 in Medical and Rehabilitation Benefits and Attendant Care Benefits, and up to $400 per week in Income Replacement Benefits. If you are not working as a result of your accident, you may also qualify for a non-earner benefit of $185 per week.

There are also additional benefits that may be available to you if you have suffered a catastrophic injury, such as paralysis or a traumatic brain injury or if you have purchased optional benefits through your insurer.

  • PEDESTRIAN ACCIDENT INJURIES
    PEDESTRIAN ACCIDENT INJURIES

Most pedestrian crashes involve a forward moving car. In such a crash a walking or standing pedestrian is struck and accelerated to the speed of the car and then continues forward as the car brakes to a halt. The pedestrians are impacted twice - first by the car and second by the ground. Pedestrian accidents are among the most serious ones in the road traffic incidents. Unfortunately, many of them result in traumatic brain injuries or injuries to the lower limb (knee joint and long bones) which are the most common cause of disabilities. Other common injuries include fractures, spinal cord injuries, torn ligaments, facial injuries, scarring and in several cases amputations.

If you or someone you love has been injured in a pedestrian accident, it is important that you learn your rights as you may be entitled to compensation for your pain and suffering, your past and future loss of income and future medical treatment. The brain can be driven into the the skull by a sudden blow, or by the force of shaking or whiplash. In either case, the brain can suffer bruising and swelling, and in some cases the impact can be so strong that it tears blood vessels in the brain, causing intracranial bleeding. Traumatic brain injuries can cause serious, life-threatening events and can result in permanent irreversible damage to the brain. • LONG TERM DISABILITY
    LONG TERM DISABILITY

Canadian consumers can obtain long-term disability coverage through their places of employment or as part of group coverage plans. There are also individual plans available for purchase. The basic principle of long-term disability insurance is for the insured and/or their employer to pay regular premiums in order to secure coverage that is intended to provide financial assistance (benefits) in case the insured suffers a qualifying disability. These qualifying disabilities are often caused by motor vehicle accidents or other incidents that result in injuries and inability to return to work. In the event of an actual disability, the process of obtaining long-term disability benefits can be long and confusing. It is not unusual for the insurance companies to deny applications for benefits despite regular payments of premiums and inability to return to work.

If you or your loved one have been recently denied long-term disability benefits by your insurance company, it is important that you don’t take their decision as the last word and learn more about your rights. Lofranco Corriero has experienced lawyers who can help you receive your owed benefits. Our team will examine your long term disability policy and determine if your insurer was unfair in denying your benefits. Call us now at 1-866-LOFRANCO to learn more about your rights and/or to schedule your first free, no-obligation consultation.

  • OCCUPIERS LIABILITY LITIGATION
    OCCUPIERS LIABILITY LITIGATION

The Ontario government created the Occupier’s Liability Act in order to address liability in the case of on-premises injury. The law defines an “occupier” as someone who is in physical possession of a property (i.e. homeowner) or a person who ultimately has responsibility for a property’s safety (i.e. landlord). The Occupier’s Liability Act covers injuries occurring on or in: private properties, public parks, school yards and playgrounds, malls, grocery stores, apartment buildings, private homes, swimming pools and all other properties except for municipal sidewalks and roadways. Under Ontario law, an occupier owes all persons who enter onto a property a “duty of care”. This dictates they must maintain premises in a reasonably safe manner under the circumstances of each case. If they do not comply with the rules they may be likely liable for any injuries sustained on their premises. However, there are also certain nuances that the injured persons must be aware of. The law stipulates that your own actions can also have an impact your ability to hold a property owner liable for your injuries.
